domicile certificates

i am originative of bihar. i am staying with all family in sangam vihar for last 10 years. i am applied for the domicile of delhi 2 months back but my application has been rejected. when i asked for the reason. i was informed that since i was away from delhi between 2004 to 2007. where as i was in u.p for education purpose. wheather it is necessary to reside in delhi continously in delhi last for 3 years. but i am residing in delhi from last 10 years with my family. in delhi we have a own house in name of my elder brother. and my name is also listed in ration card from last 10 years and there is a gas connection in my name from last 10 years. presently i am doing computer course from NSIC institute. i have not taken domicile from any state. can i get a domicile of delhi? please reply at the earliest.

In such circumstances, clerical staff as well as immediate higher authorities don't know the legal position, therefore they refuse on one or the other pretext to fetch money. Your strict reaction may compel them to honour your legal right. Same is in Pakistan, too. Where person reside more than three years or have educational certificates, he is entitled to get domicile from that place.

You should approach the authorities with all your documents; and if they refuse even at the higher level, you may need to approach the court.
