Legal Question in Civil Rights Law in India
if on the face of the plaint which was send along with a letter under order 39 rule 3 proviso. it appears from the copy of the plaint that the claim is barred by limitation. No writ of summons has yet been served on the defendant. Can the defendant at this stage apply for rejection of the plaint under order 7 rule 11(d)?
