Legal Question in Civil Rights Law in India

MY family and my brothers family residing in house from 30 years.But sale deed of house is on my name but all necessary document to prove brother existance in my house also present like his election card,driving licence, Ration card and many more.so what should i do to vacate primises allocate to my brother.he also costructed first floor of my hoouse and residing there more than 10 years. Is he legaly safe?.If i will file case agaist him then what is case condition? My brother and me file case agaist one party in1996 and all document notices of this case is receive on my house. address of communication is also of my house to both of us.If i will file case against my brother then will i win?

what is the status of your brother

is he is a tenant ? paying you rents if not than yes u can ask them to vacate the property
