Legal Question in Civil Rights Law in India
My father died intestate in July 1997. He is survived by four legal heirs, myself, 2 brothers and my Mother. He purchased a flat in Hyderabad in the joint names of himself and my Mother. The property is now registered in his name after his death. Can my mother now will the property to any of her three sons?

as your father had died intestate i.e. without making a will, the flat at hyderabad would be divided amongst all the legal heirs viz. you, your brothers and your mother equally. in case your mother is willing to give you the flat and your brothers have no objection to it, then you need to apply for succession in your name and your brother and mother may relinquish their rights in the property before the court.
