Legal Question in Civil Rights Law in India
my father had died on 30.6.10 leaving behind my mother, three daughters and one son. he had made an unregistered will in favour of my mother and my brother. Actually my father was only son of his parents. after the death of my grandfather in 1998, all his property was tranfered to my father. My grandfather migrated from pakistan to Punjab in India. Property left behind in pakistan was then given here to him and his two brothers. i have kursinama of that village where property is located. in that kursinama name of my grandfather's grandfather is also mentioned. Now my question is this
1. whether this property is an ancestral property
2. my father has right to make a will on this property or not
1 Answer from Attorneys
yes, the property is ancestral and you have an equal share in the property. the will cannot come in the way of your claiming the property provided you are able to prove your above contentions.
