my father had a Ghaziabad development authority(GDA) flat. he was died without any will or giving succession right to any of us. he had his wife and two daughter. then this flat was transferred in my mother name through mutation and there is a lease deed by GDA in her favour. later my mother did a will in favour of my sister without informing me and she did not give me anything.but a sentence is written on the will that she given me money and i am happy from this. My mother was died in 2006. I want to know that my legal right in my father property is transferred to my mother through mutation or it was just for transferring title in house tax etc.

secondly am i still having legal authority to have half of that flat???

thirdly my mother's will is void or not if she cannot have proper ownership of that flat?

Dear Madam,

After the demise of your father, your mother becomes the absolute owner of the flat. Since the contents of the Will made by your mother are false, the Will can be challenged by you in Court to claim that you have a 50% share in the flat belonging to your parents.
