my father wants to do registered will for his own acquired property in delhi to two of his children FIFTY PERCENT EACH after doing registred will in sub registerer if he died than property will automatically transfered as mentioned above fifty percent each or probhate is required from other childrens

Dear Sir / Madam,

A Will has to be backed by a Probate from the Court for its execution. Earlier, property could be held in joint names, which is no longer the case.

In many cases, the Society still transfers flat in two or more names, if all the legal heirs - sons and daughters have given their No Objection Certificate.

in case there is no dispute with regard to the will and the property was self acquired, there may not be any need to probate the will in Delhi.
