How to file Application under Section 340 (1) of Code of Criminal procedure in purgery of the Civil Trial Court?

In my Civil Suit filed before Hon'ble City Civil Court, Defendant submitted false evidence to refuse injunction sought by me.In pending Suit there is always Notice of Motion filed for obtaining reliefs. Kindly inform me whether I can file Application under Section 340 (1) of Code of Criminal procedure in the form of Notice of Motion. Whether it is in the form of Miscellaneous Application (M.A.). Which form will the Hon'ble Court accept?

Ask your lawyer to do it. He can do so. A Criminal action cannot be initiated in Civil Court. Civil Court may direct a person to be prosecuted by a Criminal Court.
