Legal Question in Civil Rights Law in India

can anybody file the civil case against nri?
Hi,
Presently I am staying in UAE. My own house in tamilnadu which is a property taken over from my family member by settlement in 2010 and right now I have gone for extension of my existing house. The neighbour filed the civil case against my mother as he thought that she is the owner of the house due to rain water will fallen to his side. Local Court has been put stay upto 20th Dec 2012 for stopping the construction activities.
We have replied to Local court through advocate in 11th Dec 2012 and mention that she (My Mother) is not owner of the house and we will take remedies to solve neighbour problem. Court has not taken up case till date and they have send one advocate to our house for veryifiying details and thereafter we have not hear anything from court. And Court activities was close today (21st Dec 2012) and will resume by 4th Jan2013.
Mean time I can start the my construction activities as we are not received any stay notice from court and court activities absence upto 4th Jan2012.
Please guide me as per Indian Civil law.
