can i file petition for attachment of movable i.e CAR before judgment under order 38, rule 5 of cpc

Dear Sir / Madam,
If your car has been confiscated for repeated criminal offences by the Police, or by the bank towards their claim(s) for non-payment/settlement of loan availed by you from them, or for both; with the new fast-track laws in the country, there is very little you can do for release of your car from the Police/Bank clutches.
