Your statement of fact is incomplete. The question of division may arise only on the death of a person and the property may be shared by the surviving legal heirs. The law of inheritance in India is also religion specific. In case of Hindus, the date of marriage may also be relevant.

the property needs to be divided by metes and bounds and both the wives and children would have an equal share.
