Legal Question in Civil Rights Law in India
HI,
I am Vivek, I have a property issue, My grand father owned 10 acres of land which was divided in the five brothers(my father and uncles). The division of the fields was done on a white paper with signature of all the brothers(uncles) agreeing to it. 6 acres was in a different place was divided in three brothers. And 4 acres which was near the village was divide between my Father and his youngest brother. But was never registered in the panchyath. The varsa or records in the village now says both own it.But the paper where the division says the front part of the fields belongs to my father and the behind part to my uncle. He is now cultivating the land. When we go an ask him to leave the filed he say show where the filed and tells to split the land horizontal as the value of the front land has increase as it is close to the main road. And says the division paper doesn't hold good as it is not registered. When I consulted a lawyer he says to compromise and take what ever comes as the case will take long time and also we may end up doing the division all over again. And the other brothers have taken the land as per the division paper. And i also checked in the land records department in the taluka the land is in both names. Please Suggest me how should i take it forward.

Your lawyer has given practical advise. You have legal recourse of either filing declaratory suit or to file a suit for partition provided you have patience to witness long lasting civil proceedings.
Already advised.
As advised, it is better to divide the land in an amicable way as the legal proceedings for these type of matters may prolong for years harming both sides by affecting the land value too.
