Re: Hindu succession law
In terms of Sections 8, 9 and 10 of the Hindu Succession Act, 1956, read with the Schedule appended thereto, a widow and mother of the deceased are Class I heir, as also his children;
All the Class I heir inherit simultaneously in equal shares.
Your confusion seems from the fact of mother having 're-married'. There is no provision in law to disqualify a 're-married' mother.
