Legal Question in Civil Rights Law in India
My husband has given a power of attorney a few days after we got married to his parents in September 2006, in a Registration Office in India. I would like to know:
1. What are the different kinds of power of attorney? I am not sure what kind of power he has given to his parents
2.What are the legal issues which we would face in the future due to this?
3.Is it okay to give the power to his parents, when we (myself and my daughter) solely depend on him,as I'm unemployed?
4. We stay in the US but are on a visit in India,if we plan to cancel the power what are the procedures?
2 Answers from Attorneys
1. PoA is given mainly to handle one's affairs in his absence; e.g. purchase, sale, lease, rent, transfer of immovable property; and/or handling bank accounts and similar transactions with government / private persons
2. the actions of the attorney are considered as actions of the executant of PoA
3. it is normal practice to give poA to parents when one is going out of station
4. there is no need to cancel the attorney; you are not entitled to do so; only your husband may consider cancellation if he so desires.
You should consider cancellation of PoA and allow such thoughts ONLY if you do not trust your husband.
