punishment depends upon the nature of offence proved in court and a host of other facts and circumstances of the case.

It seems you would like to know the provisions of S.138 negotiable instruments act,1881 for dishonour of cheque. Where the punishment would be 2years of imprisonment or fine of double the amount or with both as per the amendment brought in the year 2002.
