Land Acquisition Matter
Hi,
I'm seeking help in my father court case which is going for about 25yrs.
All the documents in his favor.
Previous order by Chief justice of Delhi High Court �Issue can not be frame in the case� no appeal was made by the defendant.
This is recently ignored by District court and order for Issue frame for next hearing.
How can a lower court judge cross the High court orders?
There are many facts like this including admissions by the defendants on various occasion.
Is there any way we can discuss this matter. It has been going for long time my father should get a decision.
Please help.

Dar sir,
if the facts explained by you are correct then it is advisable to prefer a Misselenious appeal before the High Court pending disposal of your suit.

The case is going since last 25 years cannot be a ground for earlt disposal of your matter.
But what you have a positive point is that you have one favourable judgement of the Hon'ble High Court. If the district court has not followed that judgement and passed the order in your case. Then you can file a writ in the High court against that interim order and stay can be granted to you. But remember every case has different facts so dont go to High court on facts but if some legal question is involved then only you are advised to approach the same. Another way to early diposal of your case is apply your case under the category of "Senior citizen".
