Legal Question in Civil Rights Law in India

Noise pollution outside my shop premises

I am a shop owner in Chembur.Just outside my shop premises, the BMC has ,through contract, commenced the work of underground sewage system since the past 10 months. The contractors have put a compressor and a water pump just outside our shop leading to unbearable noise levels. We requested them to shift the same to a bit far off place where most of the shops always remain closed and thus we can be relieved of the noise to a certain extent, without anyone else getting disturbed. They just refuse to shift the same,even though they have this option and can continue their work. I am not opposing the project but am expecting a bit of cooperation from them which they are not ready to offer. Besides, my father, age 75 yrs.,and suffering from various ailments also has to bear such high decibel noise continuously. I also talked to the contractors and brought to their notice the law regarding sound of over 75 decibels,but they are not ready to pay any heed to it. What are my options to relieve myself and my aged father from this?

Re: Noise pollution outside my shop premises

If you so wish, you may want to make a complaint with the local authorities (BMC) as also to the

(a) Chairman, State Pollution Control Board; and

(b) The Chairman, Central Pollution Control Board, East Arjun Nagar, New delhi;

(c) The Union Minister of Environment,

Priyavaran Bhawan, Lodhi Estate, New Delhi.

In your demand notice, the authorities may be given at least 15 days time to do the needful.
