Legal Question in Civil Rights Law in India

is it offence or can i Be Charged with Parental Kidnaping, of my Minor son aged 1 year, If i take him from mother and not return, an if i cross the state Karnataka,Im The Father of the child, Until now their is no court orders or anything Between my wife an me, she Has affair with 2 Men Outside The family,an I have all the proofs of it. Shes Caught an Wanted a Divorce from me, im very much concern about my son Future, In State the law Says the custody of a minor childs below the age of 5 usally goes to the mother, An The child dsnt Go the Mother like he cmes to me. Pls Suggest
