Legal Question in Civil Rights Law in India

My parents had bought the house in 1989.At the time of purchase including us one more family staying on rent.When we asked them to vacate the house,they denied.So we hadfiled a case in court on basis of shortage of space but unfortunately we lost the case in year 2000.We haven't filed any case after that and had never accepted rent from them though they submit rent in court.Now the tenant has died some 4 months back.His wife is staying in that house while only son is working in Delhi.Please let me know to whom tenant ownership will transfer and by when.Also can we ask the increase in rent charges as currently rent is very less.How can I evaluate about what should be rent amount in today date?

Look you have to showcase certain reasons to vacate the tenant if that is failed then it does not mean that your ownership itself is failed. My advice is to get rent from them regularly issue rent receipts and also if require issue notice of enhancement of rent and establish your ownership to the land at all times.
