Re: Is patta valid?

A land has been gifted to gowsala in 1946, on which the party who received the land has the patta of 1946, however the actual possession of land is with the actual landlord till now & also in government records in his name,,,Now the party who has patta of 1946 claiming the land under Rajasthan gowsala act 1960,even though it has not been registered nor they have any physical possession of land since 1946? Is that patta valid

If the gift deed was not "implemented", it may be got cancelled. since you are in possession, and the donee is wanting title and possession, the issue may be decided in civil court only.

The result of litigation may not be predicted though prima facie the donee's case appears to be weak.

May be but we have to see the case filed by gowshala and owner was you or your father etc detail.
