Legal Question in Civil Rights Law in India
One person Mr.A had purchased 1.00 acre land in 1942 through proper sale deed along with two other properties in different survey numbers. (totally 3 properties in three different survey numbers).
And he mortaged (called pokiyam deed in tamil nadu ) all the three in 1947 to one person Mr. B for a period of 5 years. he redeemed the mortage in in unregistered deed in 1952. (but no original is present for both mortage deed and release deed)
and then Mr. A he did a partition along with three of his sons with some more properties in 1961.
Now the problem is after 50 years the heirs of B are claming the property through the Mortage deed done in 1947. please do tell me who is got more chances ........

You can get copy from the SRO for the registered deeds. Without studying the Pokiyum deed and its discharge, it would not be possible for advice. On the face of it, A and his heirs appear to have a good case for ownership.
