power of attorney

sir, if a power of attorney is granted to a person say for 2 yrs and power to sub delegate. before expiry of two years can this agent subdelegate to another for 2 or more years or if for life long. what is the legality on this. can a agent with a power to subdelegate, if subdelegates, will that subdelagation be vaild even after the expiry of actual agency. thank you.

a person can sub delegate the power but the sub delegation would come to an end on the expiry of actual agency.

Sub delegation would also be maintained alongwith the POA period.

the answer is in negative. the reason behind the answer is simple one cannot delegate an authority which he himself does not possess. after two years the subdelegation would become void.

(1) The power of attorney may be cancelled or amended by the executant at any point of time;

(2) The executant of PoA will be bound by the actions of his Attorney the same way as if he has himself done those acts.
