Legal Question in Civil Rights Law in India

Hi, We have a property in Bangalore which belongs to my grandfather. Both muy grandfather.grandma and father is no more.whenever we ask for share they are denying it. The reason behind the denial is they said my father is married to two wives and that lady is also asking for share. We were not aware of other marraige of my father. My mom has registered her marraige legally and they have only photo as a proof. So they are telling my mom is second wife and she cant get the property. Eventhough we are ready to share with other wife they are not allowing us to do. I wanted to know how we can procede. My father was with us for more that twenty years and till then we dint know about second marraige. As per them my father was living with her for only 3 months and she has a girl baby. Can we share the property among all my uncles plus my mom and that lady. How the splitting happens?

You are entitled to a share in your fathers property, as long as your father accepted you as his child. Your birth certificate will show your fathers name, and as such it is irrelevant whether your mother was lawfully wedded wife or not. You are entitled to a share.

Second wife has no share in the property but the children of second wife have equal share in the property with other legal heirs..File a suit for partition to get your share.......Please check Sanjay Kalra and Associates on the internet to know more about our law firm and the legal services we are rendering for our clients from all over the World.
