Property case

Heat is my question !

My brother had put a case to distribute the property and the case is under process.

And now I want to bye a land with my own money.

Please tell me if I bought a new land of my own it will also include in the distribution.

Property which you will buy with own money in your name will not be subject of joint property and distribution. If the same is purchased with joint fund, definitely it will become part of division. Title must be in your name and consideration must be paid earned by you.

if that land that you are going to buy, would be purchased out of joint funds, then the same would be considered for distribution and if the same is bought out of personal funds, the same is not liable to be distributed.

No Kiran, any property you buy will not become part of the pool which is available for partition,if you are purchasing out of your own money, which money cannot be attributed to the joint family.
