Legal Question in Civil Rights Law in India

Property Dispute

Hi,

My father started a business in 1978. Later in the year 1984, he included his brother to the business as 50% partner. This partnership lasts for 4 years . During this period, his brother has cheated him by thefting money from the business. When my father found this, his brother asked for his share. My father settled him with the money in front of the auditor and in the settlement document, he included the following statements.

''the profit and loss of the businees will be hereafter goes to party no 1 and party no 2 can no more interfere in the business''.

Where my father is party no 1 and his brother is party no 2.

Now my question is....

During the partnership time, my father bought a land and it was registered under his name .

After 20 years, after my father's death, my uncle (My father's brother) is asking for share.

Is that is legally possible?

Please advice

Ramanathan

Re: Property Dispute

If the property is not mentioned in the Settlement Deed and the property is not purchased from the money from the partnership firm, than your uncle cannot have a right in that property.

Re: Property Dispute

Was the money for purchase of land withdrawn from the funds of partnership accounts? and was that account taken into consideration when settlement deed was executed?

In what form your uncle has raised his demand - oral, writing or legal notice?

Please write back your answers to enable me to examie the issues involved.
