Provident fund & false will

my dad expired in april 2007 before he could collect his provident fund lying with the Shipping corp of india(SCI), Mumbai. my mother is the 100% nominee. my uncles immediately on my dads death made a false will and sent it to SCI saying he has left the PF to them. the company refused to give the PF to anyone unless we produce a succession cert. my uncles applied for succession in the court of SDM Moradabad(U.P). we came to know of it and filed an objection. we have also applied for succession cert from the same court. what i want to know is if i can file for succession in Mumbai and how to go about it???

A case on same facts can not be filed in two different courts.So you can not file your case at bombay as the case is already pending at moradabad.

also file a case of cheating and forgery against the persons who have foged the will

You can apply for succession where the property is located. As the Shipping Corp. is location in Mumbai you may apply for a succession certificate in Mumbai itself.

You cannot file for Sucession Certificate in Mumbai as you have already made application at Muradabad Court.
