Riht to draw water

at the time of purchase of a land with a well therein the owner transfered absolute right over lands with a right for him to draw water from the well therein for agri purposes with the pre-existing motor to be to his neighbouring plot.Is this an easement or a contract law issue for a court?

That person seems to have transfered the right to draw water to his son with out transfering the neighbouring land.Is this transfer to third party legally correct?

The transferor sells his said lands to another person and the first transferee sells his right to draw water for a consideration. Is that sale of water rights legally sustainable and I as owner of the well required to permit drawal by the third person?
