Legal Question in Civil Rights Law in India
I as a seller accepted a token cheque of 50000 from a buyer with the condition that the cheque would be deposited in 7 days and the buyer has to check all the property documents by then. I told him on email in advance that the completion certificate is not there. After 21 days the buyer told me to deposit the cheque as the documents were clear as per him. Now 34 days after the cheque was deposited he wants his token back stating completin certificate not there. In pune nationalised banks give loan when completion certificate is not there. I have given a NOC from builder and the society to him. After I received the token cheque I stopped showing the flat to prospect buyers.
I want to fortiet the token given by him please advise

in this situation, you should have not entered the deal without the completion certificate. better return the money to avoid punitive action.
