Settlement

Sir,

My question is that my wife filed a Petition before the Hon'ble Supreme Court for transfer of civil case and now she has approached the Authority for settlement of the case thorugh Supreme Court Lok Adalat. Further some other criminal and maintenance cases are also related with this case which are pending before other Courts in CJM and Family Court. Now please help me how to get settled amicably regarding the other cases i.e whether I can place my point during the settlement process in the Supreme Court Lok Adalat of other pending cases.

You may settle the matter amicable in the Lok Adalat itself.

Sure, you should rather insist upon 'settlement' of all pending disputes together in one go. More particularly, you should make sure that the criminal case (s) are simultaneously compromised - either dismissed by trial court or quashed by the High Court / Supreme Court. In fact the normal practice in family disputes is full and final settlement of all pending disputes and disposal of all cases connected with the dispute.

yes, it is a crucial position where the LOK adalat may settle the civil dispute only without refering to criminal disputes pending against you. in case the settlement needs to be arrived, it should be for all the cases. you are advised to consult a lawyer and in lok adalat he should represent you.
