Legal Question in Civil Rights Law in India

my shop was given on leave & licence since 2006 for 3 years locking period. in 2009 license was interested in buying the same. he paid me 1/6 of the Amount as token and stop. I asked about balance consideration he made many excuses. finally I wrote termination letter and asked him to vacate the same.as the shop was in his possession i wrote to refund his amount in 2009 if he is not capable of adjusting the loan . but he ignored and carry on till today . i suit a case in mumbai Bandra small causecourt in June 2009 his advocate smarting done his job of stretching the case with one or other excuse till today. he also filed a case in bombay high court to purchase the shop with 2009 sq feet rate . now almost 3and half years have gone & license has done re-construction without my and court permission what should i do to fight.

u can file petition before High Court and High Court can bound the time for the case.
