Sir,

My friend who was a private employee stood the guarantor to a govt employee for a private chitfund (Margadarshi Chitfunds) after a year the person who taken loan expired along with my friend 3 other people who are govt employees stood guarantor to the deceased employee. They told at the time of giving surity that as you are private employee if the person dint pay the loan he is not responsible.

Please let us know person working in a private firm will his surety / guarantee valid for the govt employee and for recovery of the private chitfundd will the chitfunds moves towards the govt employees for recovery or the private employee also need to pay back the loan taken by deceased.

once if you have stood as a guarantee whether a govt or private all are laible it does not make any difference whether a private person stood as guarantee or govt servant, yes it is easier to recover the amount from Govt servants by deducting the salary. The child fund can move against all or anyone as per their choice. The liability of the surety is co-extensive with the principal debtor.
