Legal Question in Civil Rights Law in India
Sir,
My grandfather had ancestral property in his name,he was died in 1972 and also did not give any right or will to any one...he had one son and daughter,WIFE,After a long period,yr 2009 his son took a civil suit in court,this ancestrail property has equal right to his wife,son(uncle to me),daughter(mother to me)....In this case my grand mother was died in 2010(wife-died)she took a will before died(Will is register under notary),she donate her share to his daughter,so my mom get 2 share from the property,now my uncle ask 50% share from the property after my grand mother death.I was submit my will for 2 share.
My dought:On 1989 my uncle,mom,grandmother put a registered mortgage deed to third person 1/2 share in the name of my uncle,another 1/2 share in the name of my grand mother,
Now my uncle put this document for evidence for equal share. They told at the time onwards we accept for equal share,
this evidence is accepted?
