Legal Question in Civil Rights Law in India
Sir
My query is related to Supreme Court order in civil appeal no 7514-7515 of 2005, order dated 27.11.2012.
- I am a direct recruit inspector of income tax department,Govt of India and joined in the year 2008 where as my selection process was started in the year 2005.
- following the old pattern of fixing seniority ,dept has fixed my seniority in the year 2008.
- As per the latest order of Supreme Court in the case mentioned above , being a direct recruit Inspector my seniority is to be fixed in the recruitment year I.e 2005 and not in the year of joining dept I.e 2008.
-If my seniority is refixed then immediately I will be promoted to next cadre , as 2005 batch of my present cadre has already been promoted to next cader ..two years back.
I request you to give your valuable advice in the following questions of mine.
-As The Apex court has not set any time limit ...what is the time available with administration to re-fix the seniority.
-As administration is slow what legal options are available with me to compel the administration to do it quickly.
