Legal Question in Civil Rights Law in India
The sister of my father has filed a partition suit in civil court seeking his 1/4th share in our ancestral property. the case is in progress.but she want to relinquish her right in my favour i.e. in favour of defendant no. 5 who is the son of his brother. how can this deed be executed?

It is clearly evident from your query that your aunt wants to withdraw the case she has filed in the civil court seeking your father's 1/4th share in your ancestral property. To the best of my knowledge, in case there are other legal heirs involved in the partition suit which is in progress, all heirs involved in the partition suit are automatically restrained from executing any property transfer proceedings pending the completion of the case till the sitting bench of judges decide the outcome of proceedings and pass a judgement.

Your fathers sister need to 1st withdraw the case and give petition in court for settlement of case outside court and she can execute relinquish the deed in ur favour at registrars office...
