Succession Certificate

My father expired recently without leaving behind a will. An under construction flat is booked in the name of my father and mother. I am the only child. My mother wants my name to be included in place of my father's name in the flat. Is a succession certificate needed in this case? The only claimants to my father's property are myself (only child) and my mother and we both have given declaration in stamp paper for the transfer. Please let us know if succession certificate is needed.

You may approach the builder with a death certificate and an affidavit of your mother and yourself seeking transfer of the flat in the joint name of two of you. If he does not agree, you may apply for a succession certificate.

It is better to obtain succession certificate to free from any further problems in any property matter whether it is immovable or movable properties.

Obtaining Succession Certificate is better than approaching builder. It is authentic documents.
