Legal Question in Civil Rights Law in India

Unjustified notices and harassment by BMC

How does one sue the bmc for monetary compensation and direct criminal charges against corrupt officers for issuing notices and picking up my vehicle parked on the road in front of my house, under section 314 without giving notice nor adequate time nor proper hearing. Thus causing us through great unrest and mental trauma.

Seeking a stay by court was rejected to us on grounds of improper & insufficient presentation of evidence by our lawyer. However they do acknowledge the possibility of corruptness and mischief by BMC, but conclusion was in favour of bmc . Now bmc are using this and a heap of fabricated lies accompanied with a signature campaign by almost all surrounding residents who are jealous of us. They do not bother to verify facts and act possibly on huge briberys. I wish to file charges personally in order to make an example of them. proving that the law is decided by what is legally right and wrong and not by majorities and minorities.

If I do not park my tax-paid vehicle close to my house ,that too on a dead end side area of the road, considering that my building is a 100+ year old building without any parking place, then where else do I park. Corrupt authorities are misusing their offices ,without checking facts.

I would advise you to file a writ petition in the Bombay HC.

Take help of a local lawyer and let him know whole issue with details.

The litigation is very costly and tiring. You may try to settle the matter at rest and buy peace.
