Vacate an adamant tenant

Hi,

I am owning a house in Chennai and rented to a tenant. I am staying in my second house.

Asking the tenant to vacate for more than a year since he is not paying us the rent regularly and not happy with his behavior with us. 6 months back he gave us a written agreement in a stamped paper (Rs 20) that he will vacate in 6 months. Now the period is over but still he is not ready to vacate and still asking for 3 more months.

Can I file a complaint in the court asking him to vacate legally and how long it will take legally. I can use the agreement that he signed.

OR

Can i file a complaint in police since he is defaulting the rent. Which one is better?

Note:

He is not paying the rent regularly to us. Only pays in the end of the month and that too with multiple calls.

In the agreement it is mentioned that the he did not pay us the rent for 2 months.

File a case of eviction in the court. You cannot file a case in the police for non payment of rent.

You may seek eviction on the ground of non payment of rent. police complaint may not be maintainable.
