validity of agreement

A sale deed was registered. stamps were purchased neither in the name of vendor nor in the name of vendee. will it effect the transaction in any way. what are the legal implications. thanks

Sale Deed may be impounded upon presentation before public officer/servant for the making up of deficiency of stamp papers in the name of seller for purchaser. Sale Deed is valid but involves some defect which is curable in nature.

It will remain not acceptable in evidence unless deficiency is made good.

If the stamp papers does not bear anyone's name then they can be treated as stolen.

You may have to pay the stamp duty.

It wont affect the transaction.

The stamps-papers have to be purchased in someone's name; otherwise the stamp-papers may be treated as stolen or fabricated. However, the deed may still be valid and the beneficiary may have to pay the stamp duty again. The transaction should remain unaffected.
