Legal Question in Civil Rights Law in India

my wife harrases me physically by injuring leading to bleeding. I had filed a divorce case in the court one year back and i had appeared before court twice but my opposite lawyer took the dates. I am ready to provide a big lumsum amount to her and this has been conveyed to her lawyer. My wife is not willing to give divorce. Can they file a case against me under 498 A even when the divorce case is pending in the court. guide me

already replied lots of time. people like u should be charged coz free help is not meant for the people who misuse the same and take it so lightly like sitting in the que for taking langar. plz mind it and ask accurate questions only to get the proper guidence else engage any local counsel that is the best idea for you.

a complaint u/s 498a is filed under criminal law and your divorce is under civil jurisdiction. a complaint can be filed by your wife as there is no bar.

A complaint by wife, made after filing of divorce petition by the husband, may not stand legal scrutiny as it may be termed as a 'counter blast'. However, you may continue pursuing your efforts for settlement by payment of one time alimony amount. Wish you good luck.
