Will

Hi.. My grandpa wrote his will on his son's name. My mom was not aware and filed case against her brother after grandpa's death.Is there any chances for my mom getting a share ? Can we break the will ?

in case the property is joint family, your mother has an equal share in the property despite the fact there is a will. in case it is a self acquired property of your grandfather, in that situation, the will is going to hold good. you need to prove that it is a joint property and not earned by grandpa on his own.

If the will is genuine and the property was acquired by your gradpa out of his own resources, i.e. not ancestral, there is no point in contesting. your mom may better consider compromising the issue with her brother.

if it is your grandfather's selfacquired property then your mother will not get a share as he has willed the same to the son

Right to claim inheritance is subject to joint property. Self acquisition of property disentitle from inheritance except to Will.
