Legal Question in Technology Law in India
regulation of obscenity in light of the internet?
The present basis for censorship laws, right from Hicklin to Miller are based on the principle of Community standard and protecting morality of a society. in light of the Internet, this 'community standard' can obviously not hold.
what then can be the judge of what determines obscenity?

The standard will, I suppose, be that of the jurisdiction in which the court which is called upon to decide the issue is located. This means that the law may vary depending on who is deciding. Some websites may be pretty much immune from suit because they are run from a country with liberal laws and have no ties to nor assets or in a strict country.
