Legal Question in Technology Law in India
I am a software engineer. I was on notice period from the employer for one month. During the notice period, I was on emergency leave and informed the company through message(I have the proof of the message) and also updated in the internal system of the company saying "I am on leave". after 15days of leave I reached back to the company and Now the company say you are absconding from the company, they cancelled my employment without any notification and they are not ready to take up the relieving process at all. and the company is with holding 42days salary as well as 9months arrears.
They says "SMS is not considered as the prior channel to communicate, they wanted a mail" and they did not consider my updates in the internal system of the company site regarding the leave.
Now how can I proceed further, in order to relieve from the company?? Please guide me.
