Cash for query

The Supreme Cour of India dealt with this issue as a contract.

The MPs in question received two payments for the same work, once from pubic as allowance and again from a specfic individual. Thus they defrauded an individual. Should a fraudster be allowed to continue as MP. Can this be appealed in the Supreme Court again without exense.

You should better engage a counsel for a litigation of this nature. An on-line opinion may not be really helpful.

However, the law is well settled that if a public service, including a MP/MLA, receives 'illegal gratification' he can be prosecuted under the PCA.
