Legal Question in Constitutional Law in India
nexus between governmant and kandhari
MCD had removed kandhari coal depot from governmant land near PS kalkaji delhi and had written to delhi police to keep strict vigil to stop re-encroachment. However kandhari has re-encroached same governmant land and has taken regular electricity connect vide meter no 23556728 from BSES . complaints are made to MCD, DELHI POLICE, BSES etc but they are giving reply that since matter is sub-judice vide FAO 264/2006 shagan lal kandhari v/s MCD and others therefore they can not remove RE-ENCROACHMANT AND DISCONNECT ELECTRICITY till case is finally settled . CAN GOVERNMANT TAKE THIS EXCUSE TO HELP LAND MAFIA AS COURT HAS NOT GIVEN ANY PERMISSION TO KANDHARI TO RE-ENCROACH AND CREATE NUISSANCE.
