Legal Question in Construction Law in India

I am living in a house for 28 years in municipal area. And the land is registered as dwelling place in BLRO..i am paying tax to municipality from 1998 as an occupier. I have the mutation in my name. Now i want to construct two rooms in the said place. Can i pass the plan in municipality?? And can i get a house building loan from bank on those document. I am from west bengal

Dear Sir / Madam,

Mutation of property is the recording in the revenue records the transfer of title of a property from one person to another. The mutation in the municipal records is for the purpose of payment of property taxes only, and it does not mean a legal title to the person to whom the property has been mutated.

It is advisable that you convert the mutation to become an owner of the land by filing an application with the District Land Tehsildar / Registrar in Bankura, pay the prevailing Stamp Duty on the transfer, if any, get your name registered as the Owner of the land, and only thereafter proceed with the construction, to be free of any unforseen complications which may arise in future.
