Legal Question in Construction Law in India

non payment of my carpentary work

Respected sir,

I have worked for acompany as labour contractor for a year in which i had a labour work of almost RS.16 lakhs (Rupees sixteen lakhs) and he has paid me only a sum of Rs9 lakhs (Rupees nine lakhs) now he has paid me Rs25 thousand (Rupee twenty five thousand) in last six months. He is not paying me saying that he not got payment from the pantloons which he worked for.he accepted my all the given bills(two bills pending to be delivered) by deducting TDS on the same. And he has purchased a new office worth Rs.200 lakhs (rupees two hundred lakhs). Now how can i get my money legally or say can i get my money legally. Because last 9 to 10 months have been very harsh for me physically and mentally too. To extent that i have even thought of commiting suiucide because i was a very small labour contractor and he showed me big dreams and used me.And now it wont be wrong saying that he indirectly forcing me do his work.which i dont want to do. Because whenever i cakll him for my money he says we have work to start how many men do u have and i even cannot say no to him as iam scared that he will not give my money. and because of this immense tesion i couldnt do any other work because i was not finding my meantally stable to doit

Re: non payment of my carpentary work

in case you can prove with the help of bill that he owed you rs. 25L and he has only paid 9 L, u may file a suit for recovery for the balance along with interest. in case there is no documentary evidence, then u stand to lose that money. but u must not lose hope. ther is always a sunny day after the horrifying night
