Legal Question in Construction Law in India

I've a property with basement boundary now I need to build a wall on it but my neighbor plot holder will not allow to construct because of some stones are projected to his plot .the basement have an old of 15 years. he is saying to re construct it. may i have any legal support to build the wall

Dear Friend,

If I am correctly interpreting your query, "Basement" you are referring to here is the boundary wall of your plot in Kollam, Kerala. Both, you and your neighbouring plot owner must have mutually agreed to the thickness of the common wall between your plots. There is every likelihood that the boundary wall being 15 years old, it may have given way at a few places. Ideally, since your neighbouring plot owner is now insisting that the entire wall be reconstructed / repaired, both of you should equally share the expense of re-erecting the common boundary wall between your plots.
