Review of Judgements
I filed an appeal on dismissal order of my Executive petition order of a District consumer forum before State forum of Tamilnadu.. The State forum upheld the lower court order in Sep 2008. By December 2008 I came to know the Judge who was hearing my petition was a respondent in a case against him before Madras high court that challenged his very appointment on intellectual capability to hold the post. Subsequently he was not allowed by a warrant to hear further cases.Apex Court is seized of the case now on an appeal by the deposed Judge. Is there any precedence wherein the judgments passed by a deposed judge on similar grounds sent for review?.

YOY SAY THAT THE SAID JUDGE WAS RESTARINED BY A WARRANT TO NOT TO HEAR FURTHER CASES. IF THAT BE SO, HE HAD NO AUTHORITY TO HEAR YOUR APPEAL AND THUS YOU CAN CHALLENGE HIS ORDER BEFORE NATIONAL COMMISSION ON THIS POINT ALSO. I DO NOT KNOW OF A PRECEDENT WHERE THE JUDGMENT PASSED BY A JUDGE, WHOSE COMPETENCE AS JUDGE IS SUB-JUDICE BEFORE HIGHER COURT, HAS BEEN REVIEWED ON SUCH GROUND.
