Legal Question in Construction Law in India
hi, i stay in a flat built on 160 sq yards which has a basement and 3 floors i.e ground , 1st and 2nd. The roof rights lay with owner of 1st and 2nd Floor. i own the basment and ground. The owner wants to construct on the 3rd floor and has been harresing me for NOC.
The main issue remains that the building strcuture is not strong and may not be able to take the load. Secondly it would be illegal to build 3rd floor in the current plan. the owner of 1st and 2nd has told me that we will pay and get a structure certifiacte and i will not be able to do any thing.
please help me.

You may as him to let MCD sanction his building plan and challenge the same if it is granted on the basis of condition of the building.
