Legal Question in Consumer Law in India
I have booked flat in March 2012 paying 1.25lkhs advance.But due to some financial reason I could not make the payment for 7 months.Builder send me a letter for asking interest @24% for balance due.When I approached to him for paying the earnest amount, he has informed that the flat already been sold and if I want to continue with booking he will be giving current rate on available flat. Can I take some action against builder?Or give me suggestions.

It depends upon the terms and condition of agreement. Kindly check what rate of interest has been laid down for delay in payment. Otherwise, 24% is arbitrary and can be questioned. Secondly selling out of flat without intimation is also illegal and consumer complaint will lie for that.
